Military Leave. New York State employees are entitled to employment protection when they serve in the Armed Forces. The Military Stipend provides a salary supplement to assure that the employee’s biweekly salary remains at least at their New York State biweekly salary level. Refer to Military Stipend in this manual for more information. Types of Military Leave. State civil service employees are entitled to receive their state salary for the first 30 calendar days, including weekends, while on long-term or short-term military leave for active duty, provided they meet the qualifying service criteria for the military leave taken.
Military leave, as specified in Government Code section , allows the period of military leave to be treated as continuous service upon reinstatement to an employee's former position. Retired Annuitants appointed pursuant to Government Code section do not receive service . The agency personnel office must calculate the Department of Defense's (DOD) gross hourly salary rate based upon data recorded on the employee's DOD pay statement for the period of service that corresponds to the dates for which the employee is scheduled to use the day off-set military leave.
